Can Foreigners Buy Land in the Philippines? What OFW Families Should Know

Land ownership in the Philippines is constitutionally reserved for Filipino citizens. Here's what that actually means for house-and-lot buyers.

The Baseline Rule

Under the Philippine Constitution, foreigners cannot directly own land — this applies to house-and-lot and lot-only inventory alike.

Legal Pathways That Still Apply

Through a Filipino Spouse

Property can be titled under a Filipino spouse. Note: this does not give the foreign spouse legal title to the land itself.

Through a Philippine Corporation

A corporation where Filipinos own at least 60% can purchase land. Foreigners can hold up to 40% equity in that corporation.

Long-Term Lease

Foreigners can legally lease land long-term (up to 50 years, renewable once for 25 more) and own the structure built on it.

For OFW Families

Most of our buyers are Filipino citizens (including OFWs), who face none of these restrictions and can purchase directly. If you're buying jointly with a foreign spouse or partner, talk to your agent about the right structure before reserving a unit.
